Alpine Heights Homeowners Association governs a single-family home subdivision in Payson, Arizona. This Declaration of Restrictions applies to all lot owners in Alpine Heights and covers land use, construction standards, architectural review, maintenance, assessments, and enforcement. The community is exclusively single-family residential, with minimum square footage and design requirements.
- Construction & design standards: All homes must be new construction, site-built (no moved dwellings), with a minimum livable area of 1500 sq ft (excluding garage). Roofs must be pitched with overhanging eaves; roofing materials limited to tile, asphalt, fiberglass composition, or colored metal (no bright/reflective colors). Maximum building height is 35 feet. Setbacks: front 20 ft, rear 20 ft, interior sides 7 ft, street-side yards for corner lots 15 ft. Each home must have a garage (cannot be converted to living area unless new garage at least 250 sq ft).
- Architectural review: No major exterior change (including color) may be made without prior written approval of the Architectural Committee. The Committee (up to 3 members appointed by the Board) reviews plans to ensure conformity with surroundings. Decisions may be appealed to the Board. If the Committee fails to act within 30 days of submission, approval is deemed granted.
- Animals: Only a reasonable number of dogs and cats as domestic pets are allowed; no farm animals. Animals must not create excessive noise or nuisance. Dogs must be leashed per town code. A 'public nuisance' animal is subject to town ordinance enforcement.
- Leasing & rentals: Leases/rentals allowed only for a minimum term of six months. Only one 'Single Family' (as defined) may occupy the home. Subleasing is not permitted. Leases must be in writing and require tenant to comply with all governing documents. Owner remains responsible for tenant compliance and damages.
- Parking & vehicles: No commercial vehicles over 1 ton, semi-trucks, or unregistered/inoperable vehicles may be parked on lots or streets for more than 24 hours. RVs, boats, trailers cannot be parked on streets over 24 hours. RVs cannot be used as dwellings. No vehicle or structure over 3 ft high may obstruct a neighbor's driveway view.
- Assessments & fees: Annual dues are set by the Board, initially capped at $25 per lot per year. Any increase requires majority vote of qualified members. Dues are due October 1st; a $10/month penalty applies if unpaid after 30 days. Unpaid assessments may lead to a lien or other enforcement.
- Enforcement & violations: The Association may enforce rules through suspension of voting rights or services, self-help, lawsuits, and liens. For non-payment or other violations, the Board must provide notice, allow 10 business days for response, and 60 days for cure before escalating. Owners also have the right to enforce restrictions.
- Maintenance & vegetation: Lots must be kept free of trash and debris. Trees (trunk over 6 inches diameter) may not be removed without town consent. Mistletoe must be removed. Lots must not pose a fire hazard. The Board may correct violations and add costs to the owner's assessment.
