What Summer Set's governing documents say
Summer Set (Catalina Foothills, AZ) is a single-family home HOA. This document is a Third Amendment to the governing CC&Rs, adding two new rules: (1) restrictions on short-term leasing and vacation rentals, and (2) a bulk refuse collection program with an opt-out right for current owners. These rules apply to future lot purchasers; current owners as of the recording date are exempt from the leasing restrictions unless they opt out of the bulk service.
- Leasing & rentals: Owners may only lease an entire lot (not individual rooms or separate structures) to a single family for an initial term of at least 90 days. Vacation rentals, home exchanges, timeshares, and any use with a term under 90 days are prohibited. Leases must be in writing and subject to the governing documents. Subleasing and assignment of leases are banned. Owners must provide lessees with copies of the governing documents and notify the association at least 10 days before the lease term begins. These restrictions only apply to owners who become record owners after the amendment is recorded; existing owners as of the recording date are not bound.
- Waste & trash services: The association board may enter into a bulk service agreement for waste management and refuse collection for all lots. The board can either include the cost in annual assessments or direct the provider to bill each owner separately. If billed through assessments, owners who opt out receive a credit for their proportionate share. Owners who become record owners after the amendment is recorded are automatically included and cannot opt out. Owners who were record owners at the time of recording may opt out by providing written notice within 30 days after the association's notice of intent to enter into a bulk agreement. Owners who opt out must arrange and pay for their own service and cannot use any other provider for covered services.
