Drexel Heights is a standard single-family home subdivision (Lots 1–10) in Tucson, AZ, subject to a Declaration of Covenants, Conditions, and Restrictions (CC&Rs). The association maintains common areas, and all lot owners are automatically members. The rules govern land use, architecture, maintenance, and assessments.
- Architectural review: Any building, addition, fence, wall, or planting exceeding 5 feet in height requires prior written approval of the Developer (or later a majority of lot owners). Plans must be submitted; failure to respond within 30 days is deemed approval.
- Commercial & nuisance restrictions: No commercial or business enterprise (including professional use) is allowed on any lot. No noxious or offensive activities, loud music, or public nuisances. Each lot must be kept neat.
- Vehicles & parking: All vehicles stored on a lot must have a current license and be in running condition. No unlicensed or inoperable vehicles allowed.
- Pets: Up to two domestic cats and two domestic dogs per lot are allowed (small caged birds exempt). More than two cats require Developer approval. Pets must be confined to the owner's lot.
- Fences & walls: Perimeter fences (east, south, west, north boundaries) require Developer consent. Walls on zero-lot lines: each owner maintains their facing side and must provide reasonable access for the neighbor's maintenance.
- Manufactured homes banned: Trailers, mobile homes, and manufactured homes are not allowed in the subdivision.
- Association & assessments: The homeowners' association maintains common areas (private streets, drainage, landscape buffers). Each of the 10 lots pays an equal share of assessments; invoices may be sent semi-annually. Unpaid assessments accrue 12% annual interest and become a lien on the lot.
- Maintenance responsibilities: Lot owners maintain their lots, including easement areas. The association maintains common area walls (paint/repair on the common side) and drainage facilities; owners maintain walls on their lot side. Association must carry liability insurance.
