What Habitat at Timber Sky Condominium Association's governing documents say
Habitat at Timber Sky Condominium is a 40-unit leasehold condominium in Flagstaff, AZ, developed by Habitat for Humanity of Northern Arizona. It is an affordable housing community: only qualified homebuyers with income at or below 100% of Area Median Income may purchase a unit. The condominium is part of the larger Timber Sky master-planned community, so owners pay assessments to both the condominium association and the master association. Units are held under a ground lease from the City of Flagstaff, and the City retains certain rights. This document is the full Declaration of Condominium and Easements, the primary rulebook for the community.
- Unit ownership & leasehold structure: You own a leasehold interest in your unit's land (from a ground lease) and own the residence (home) on it. You also own an equal 1/40 undivided interest in the common elements. Your interest cannot be separated from the unit. The City of Flagstaff owns the fee title to the land.
- Affordability & income limits: Each unit may only be sold to a 'Qualified Homebuyer' – a household with income at or below 100% of Area Median Income (AMI) at time of purchase. This restriction is enforced via a recorded Affordable Housing Restriction and the City is a third-party beneficiary.
- Assessments & fees: You must pay regular and special assessments to the condominium association for common expenses, plus separate assessments to the Timber Sky Community Association (master association). A $100,000 Habitat HOA Fund was set up to subsidize a portion of assessments for up to 10 years, but that fund is between Habitat and the City, not a direct benefit to you.
- Leasing & rentals: The declaration includes a section on 'Leasing and Occupancy Restrictions' (Section 4.14), but the full text is not available in this document. Any sublease (including Airbnb or VRBO) requires the owner's consent and must comply with the rules. The declaration prohibits timesharing.
- Pets: The declaration has an 'Animals' section (Section 4.6), but specific limits (number, type, etc.) are not included in this excerpt. The association may adopt rules governing pets.
- Parking & vehicles: Parking spaces are part of the common elements, and the declarant may allocate certain spaces as limited common elements for exclusive use of specific units. The declaration allows rules on parking and motor vehicles (Section 4.8).
- Habitat oversight & right of first refusal: Habitat for Humanity retains oversight rights for up to 10 years after the first unit sale (Period of Habitat Oversight). During this period, Habitat's consent is required for certain actions (e.g., granting easements). Habitat also has a right of first refusal to repurchase units, as recorded separately.
- What this document doesn't cover: This excerpt is incomplete – it cuts off mid-section and does not include the full text of use restrictions (e.g., pet limits, leasing terms, sign rules), maintenance duties, insurance requirements, or the association's bylaws and rules. The actual governing rules may be more detailed in the full declaration and supplemental documents.
