This is a declaration of covenants, conditions, and restrictions (CC&Rs) for Mountain Vista Estates Unit No. 3, a single-family home subdivision in Fortuna Foothills (Yuma), AZ. It establishes rules that apply to all homeowners in this phase. Living here requires compliance with architectural standards, property maintenance, and use restrictions overseen by an architectural committee.
- Use & occupancy: Lots are for residential use only. Only one detached single-family dwelling, no more than two stories, is allowed. Minimum floor area is 900 square feet unless approved by the architectural committee. No temporary structures may be used as residences.
- Setbacks & building placement: Front wall of any building must be at least 20 feet and no more than 40 feet from the front lot line. No buildings or structures (except fences or walls) are allowed between the front wall and the front lot line.
- Fences & walls: Rear and side lot line fences or walls can be up to 6 feet high. Fences or walls within the front setback area cannot exceed 3 feet. All fence designs must be approved by the architectural committee.
- Pets: Only dogs (ordinarily kept on leash), cats, and birds are allowed. Commercial sale, breeding, or grooming of animals is not permitted.
- Vehicles & storage: Boats, boat trailers, or travel trailers cannot be stored on streets or common areas. Junk cars, auto parts, construction materials, and other unsightly items are not allowed. Inoperable vehicles must be garaged or hidden from public view.
- Architectural review: Any building, fence, wall, or exterior alteration requires prior written approval from a three-person architectural committee. Plans must be submitted showing design, materials, colors, and location relative to surroundings. If the committee does not approve or disapprove within 30 days, approval is deemed granted.
- Signs: Only 'For Sale' or 'For Rent' signs (max 4 square feet) and one political sign per candidate or legislation are allowed. No other advertising signs are permitted.
