It is an HOA with party-wall townhouses; you own your unit and are responsible for its maintenance, including the roof and exterior. The community is subject to strict age and occupancy rules under the Housing for Older Persons Act (HOPA) and Arizona law.
- Age restriction (55+): At least one occupant must be 55 or older. No one under 18 may reside or stay as a visitor for more than 30 days in any 12-month period. Surviving spouses and caregivers (with Board notice) may remain. Annual registration required to verify compliance.
- Leasing & rentals: Leases must be in writing, for a minimum of 30 days (no transient/ short-term rentals). You may not rent only a portion of your unit; renters cannot sublet. Notify the Association within 10 business days of any lease or sale.
- Pets: Maximum two domestic pets per unit (cats, dogs, small indoor birds, fish). Livestock, reptiles, and rodents are prohibited. Pets must be leashed when off your property; owners must clean up waste. Breeding or commercial purposes are not allowed.
- Architectural review: All exterior alterations (paint, fences, landscaping, etc.) require prior written approval from the Architectural Committee and Board. Submit plans with two sets of specs; response within 30 days. Exterior paint must be from an approved Benjamin Moore palette. Work must be completed within 90 days from start (or 180 days from submission).
- Parking & vehicles: No parking of inoperable, junk, or commercial vehicles on any residential site. RV, motor home, camper, or similar vehicles cannot be parked on subdivision streets for more than 72 hours in a 30-day period and cannot be lived in. No parking on sidewalks or in front/behind another owner's property without permission.
- Assessments & fines: Annual assessments cannot increase more than 20% over the prior year without membership vote. Special assessments require a majority vote. Late fees: 10% of due amount or $15, whichever is greater, plus 10% annual interest. Fines for violations: first notice, then $50 second notice, then $500 per month for continued noncompliance.
