Jefferson Park Addition is a single-family residential subdivision in Tucson, AZ, governed by a 1926 Declaration of Covenants, Conditions, and Restrictions (CCRs) and a 1936 amendment. These rules apply to lot owners. Note: the original CCRs contain racially restrictive covenants that are unenforceable under modern law (Fair Housing Act of 1968).
- Use restrictions: All lots are restricted to residential use only. No stores, apartments, boarding houses, or similar commercial uses are allowed.
- Racially restrictive covenants (historical, unenforceable): The original 1926 CCRs prohibit sale, lease, or occupancy of any lot to persons of African or Asiatic blood or not of the white or Caucasian race, except domestic servants. This provision is now void and unenforceable under the Fair Housing Act.
- Minimum construction cost: Minimum house construction costs varied by street: $4,000 (certain streets), $3,500 (Hampton, 3dleon, North, Spring, Campbell between Seneca and Spring), and $2,500 (Water, Silver, Copper, Campbell between Spring and Copper).
- Setback & building placement: Residences must face the front property line and be set back at least 30 feet from the front property line. The 1936 amendment also requires a minimum 6-foot side setback from any lot line.
- Architectural review: All building plans must be approved by the developer (originally Haskell Cohen, later Columbia Cattle Company or its authorized agent) and comply with the City of Tucson Building Code.
- Exterior materials: Per the 1936 amendment, all buildings must be constructed of finished brick, painted brick, concrete, or stone, or have the exterior plastered or stuccoed.
- Alcohol & sale of intoxicating liquor: No part of the property or any building may be used for the sale or manufacture of intoxicating liquor as a beverage.
- Reversion & enforcement: A breach of any restriction gives the original developer or successors the right to re-enter and take possession, or to seek injunctive relief. Other lot owners may also enforce via legal remedies.
