What San Clemente Blocks 5 and 6's governing documents say
This document is a 2026 amendment to the 1938 Declaration of Covenants for San Clemente Blocks 5 and 6 (Kleindale, Tucson, AZ), repealing a racist racial-restriction covenant. The original 1938 Declaration included various residential and architectural restrictions, most of which expired January 1, 1980. This amendment is ancillary — it addresses only the repealed racial clause and does not provide the current full governing ruleset.
- Racial restriction (repealed 2026): The 1938 Declaration prohibited selling, leasing, or occupying property to persons of 'African or Asiatic descent, or to any person not of the White or Caucasian race,' except as domestic servants. This clause was perpetual (unlike other restrictions that expired in 1980) until formally repealed by this April 2026 amendment.
- Residential use (expired 1980): The 1938 Declaration restricted use to private residential purposes only—no business, apartments, hotels, or rooming houses. Livestock was prohibited except domestic pets. These provisions expired January 1, 1980.
- Architectural review (expired 1980): The 1938 Declaration required written approval before construction, mandated a minimum building cost of $5,000 (1938 values, amended 1939), set building setbacks at 5 feet from side lines and 25 feet from front street, and required detached garages to be at least 50 feet from street lines. These provisions expired January 1, 1980.
