Desert Reins is a residential community in Maricopa, AZ, subject to a special declaration that requires membership in the Central Arizona Groundwater Replenishment District. This document is not a full HOA rulebook; it only governs water-related fees and liens that run with the land. All owners must pay replenishment assessments, activation fees, and reserve fees to CAWCD.
- Water replenishment fees: Each parcel is subject to a Replenishment Assessment based on its groundwater use, an Activation Fee (per housing unit), and a Replenishment Reserve Fee (pro rata share of projected excess groundwater demand). Fees are set by CAWCD.
- Payment & due dates: The Activation Fee and Replenishment Reserve Fee must be paid before the state real estate commissioner issues a public report authorizing sale of subdivided lots. The Replenishment Assessment is levied annually.
- Lien & personal obligation: Unpaid Replenishment Assessments create a continuing lien on the parcel, and the owner at the time the assessment came due is personally liable. CAWCD has rights and remedies under Arizona law for nonpayment.
- Amendment requirements: This declaration may be amended only by written agreement of CAWCD, the Arizona Department of Water Resources, and owners of 67% of the total area of the property, or by changes in applicable law.
- Binding effect: The covenants run with the land and bind all current and future owners. By accepting a deed, each owner agrees to the terms.
