What Leisure World's governing documents say
This is an individual Maintenance Agreement between a unit owner and the Leisure World Community Association (a planned community in Mesa, AZ, likely a condominium or attached-home style). It governs a specific owner-requested alteration project (e.g., adding a door, window, or screened room). This is not the full community rulebook—it supplements the governing Declaration and modifies maintenance responsibilities for the altered areas.
- What this document covers: This agreement approves a specific alteration described in an attached ACC application. The owner releases the Association from all maintenance, repair, and replacement obligations for the affected or added areas, and the owner assumes those obligations.
- Maintenance obligations after alteration: The owner must paint, repair, maintain, and replace any real or personal property affected by the project in accordance with Association standards. The Association is no longer responsible for those areas. Any further exterior changes require prior written ACC consent.
- Insurance: The project is not covered by the Association's casualty insurance. The owner is responsible for obtaining their own casualty insurance on the project.
- Non-performance and penalties: If the Association believes the owner is not meeting maintenance obligations, it gives written notice. The owner has 30 days to perform. If not, the Association may do the work, and the owner must pay the cost within 5 days of demand, plus interest at 18% per year. That amount is secured by the Association's lien rights.
- Painting responsibilities: The Association remains responsible for painting the original exterior surfaces of the Manor (up to the original square footage). However, within 30 days after construction, the owner must paint the new exterior to match the rest of the Manor. Interior painting is always the owner's responsibility.
- Construction timeline and approval: Work must start within 60 days and be completed within 120 days of approval. If the ACC does not respond within 30 days of the owner's request, the permit is automatically approved.
