What The Commons at Superstition Springs Condominium's governing documents say
This is a commercial condominium community in Mesa, AZ — the units are designed for business/office use, not residential living. You own your unit and share ownership of common elements (parking, landscaping, etc.) with other unit owners, all managed by The Commons at Superstition Springs Condominium Association. The declaration binds unit owners, occupants, and their guests.
- Permitted use (commercial only): Units may be used only for the uses listed on Exhibit B (not provided in this excerpt) and cannot be used for housing or living purposes. No immoral, offensive, or unlawful uses are allowed.
- Suite restrictions (multiple units): If you buy multiple contiguous units, they form a single suite that cannot be less than 25 feet wide. Each building may have no more than 8 suites. Suites cannot be subdivided, sold separately, or leased for more than 10 years without approval from all other owners in that building, the Board, and the Declarant (if it still owns units).
- Leasing & rentals: Leases must be in writing, comply with the condominium documents, and include a clause binding tenants to the rules. A copy must be provided to the Board before the tenant moves in. Leases longer than 10 years are prohibited for suite divisions.
- Pets & animals: No animals, reptiles, fish (except indoor aquariums), or birds are allowed unless approved in writing by the Board. Service animals for the disabled are exempt.
- Parking & vehicles: Parking spaces are part of the common elements and are assigned to specific units as limited common elements (covered spaces are allocated by deed or amendment). Only park in designated spaces. No vehicle storage, abandoned vehicles, or major repairs are allowed without Board approval.
- Exterior changes & maintenance: No exterior changes (painting, additions, landscaping, signs, awnings, etc.) may be made without prior written approval from the Board and Declarant (during Declarant control). Interior structural changes are also prohibited. Owners must maintain their units in clean condition and cannot create nuisances (excessive noise, odors, etc.).
- Assessments & fees: The Association collects annual assessments (due as set by the Board) and may impose special or supplemental assessments with member approval. The assessment amount is based on each unit's allocated share of common expenses (proportional to square footage). Unpaid assessments become a lien on the unit.
