Montelena is a master-planned community in Queen Creek, AZ, governed by the Montelena Master Community Association. This Declaration of Covenants, Conditions, and Restrictions applies to all owners, residents, and lessees within the community, establishing rules for land use, architectural control, landscaping, and common area use. Individual tract declarations may impose additional requirements for specific lots or parcels.
- Architectural review: All exterior improvements, alterations, repairs, and landscaping on residential parcels require prior written approval from the Design Review Committee (or Declarant while it owns property). This includes buildings, fences, walls, color schemes, and grade changes. No deviation from approved plans is allowed without further approval.
- Landscaping & maintenance: Owners must landscape their lot within 120 days of acquisition, including public right-of-way areas between sidewalks/curbs. All landscaping must be kept trimmed and free of trash and weeds. Owners are not responsible for Master Common Areas or areas maintained by public agencies.
- Use restrictions (home businesses): Lots are for residential use only. Home businesses are allowed if not detectable from outside, comply with zoning, do not increase traffic/parking, and do not involve door-to-door solicitation. Leasing an entire lot is not considered a business, but leases must cover the entire lot and improvements.
- Signs: Signs visible from neighboring property are generally prohibited without prior approval. Exceptions: one nameplate/address plate, one 'For Sale' sign (max 18x24 inches), one security sign (max 8x10 inches), and one political sign (allowed 30 days before election, must be removed within 5 days after).
- Nuisances & construction: No rubbish, debris, odors, or other nuisances are permitted. Exterior sound devices (except security) are restricted; backyard speakers are allowed if not a nuisance. Construction activities must keep lots neat, and the Board may limit construction hours/days.
- Easements & surrounding area: The property is subject to utility and drainage easements. Owners acknowledge proximity to Williams Gateway Airport (aircraft overflights and noise) and agricultural/crop-dusting operations (noise, dust, odors). Desert Mountain Park may also cause noise, light, and stray balls.
