This document is a partial amendment to the community declaration and bylaws—it does not contain the full set of homeowner rules. It primarily modifies developer rights, membership classes, voting powers, and assessment obligations while the community is still under developer control.
- What this document covers: This is a secondary amendment to the governing documents. It adds definitions (e.g., 'Millrose'), revises builder rights, adjusts membership and voting, and reassigns certain assessment liabilities. It does not restate or replace the original declaration or bylaws.
- Builder & developer rights: Lennar (the declarant) and other approved builders like Millrose retain broad rights until turnover: they may develop lots, build model homes, park construction vehicles, store materials, and use the community name for marketing. They have easements over common areas for these activities and are not charged for their use. The governing documents cannot be applied to materially impair these rights.
- Membership & voting: There are two membership classes: Class A includes owners and builders (except Landbanker). Millrose is excluded until after turnover. Before turnover, the declarant and Landbanker get 9 votes per lot (or 14 per acre for unplatted parcels). After turnover, they get 1 vote per lot. Class A members generally get 1 vote per lot owned.
- Assessment responsibility: All lots are not assessed uniformly (e.g., vacant lots may pay less). While the Option Agreement is in effect, assessments on Landbanker‑owned lots are paid by the declarant (Lennar). Lennar may also choose to pay assessments on Millrose lots.
- What this document doesn't cover: This amendment does not cover typical homeowner rules such as pet limits, leasing restrictions, architectural guidelines, parking regulations, or common area use. Those rules are in the original declaration and are not changed here.
