The Lakes HOA in Tempe, AZ, is a single-family residential community (with some attached homes by party walls) governed by a declaration of covenants, conditions, and restrictions (CC&Rs) recorded by the developer. The rules apply to all owners and residents, covering land use, architectural control, assessments, and use of common areas including lakes.
- Land use & occupancy: All lots must be used exclusively for single-family residential purposes. Only one single-family residence per lot, plus a garage for up to 3 cars, a guest house, and servant quarters (no food preparation in guest/servant quarters). No composition or asbestos roofs are allowed.
- Architectural review: Any exterior alteration, improvement, or change (including color schemes, fences, and landscaping) must be approved in writing by the Architectural Committee. The committee may reject plans for aesthetic or harmony reasons.
- Vehicles & parking: No mobile homes, trailers, truck campers, or similar structures may be kept on any property unless approved. Motor vehicle repairs visible from neighboring property are prohibited except for emergencies. Temporary construction shelters must be removed after construction.
- Pets & animals: Only a reasonable number of generally recognized house or yard pets are allowed, kept solely as domestic pets and not for commercial purposes. No animals, birds, or livestock may cause unreasonable noise or nuisance. Animal structures must not be visible from neighboring property. The board determines reasonableness and nuisance.
- Signs: No signs visible from neighboring property are allowed except: residential identification signs (up to two, each ≤72 sq in), one construction sign (≤3 sq ft), signs required by legal proceedings, and signs approved by the Architectural Committee.
- Leasing & rentals: Only an entire lot (together with improvements) may be rented, and only to a single family. No minimum lease term is specified. Tenants of apartments in multiple-family areas do not have access to the Beach and Tennis Club, but condo lessees do.
- Assessments & fees: Each lot is subject to annual assessments and special assessments for capital improvements, as determined by the association. Nonpayment can result in liens and enforcement. No specific dollar amounts are given in this document.
