The Village of Red Lion Creek is an age-restricted (55+) active-adult community of 85 townhomes in Bear, Delaware. This Maintenance Declaration of Restrictions (MDR) is the rulebook that binds all lot owners. It is not a condominium: you own your lot and home in fee simple, and the Maintenance Corporation handles all exterior landscaping and snow removal on your lot and common areas. No rentals are permitted — all homes must be owner-occupied.
- Age restriction (55+): At least 80% of residences must have one resident age 55 or older. No one under 18 may live here permanently; temporary visits by persons under 18 are limited to 60 days per calendar year. The community also has a rule that two adults reside per unit, with exceptions possible by written request to the Board.
- Leasing & rentals: All homes must be owner-occupied. No lot or residence may be rented, in whole or in part, at any time. Renters and landlords: this community is not for you.
- What you own & maintain: You own your lot and home in fee simple. The Maintenance Corporation provides full exterior maintenance: grass cutting, leaf/branch removal, weeding, mulching, pruning, snow removal from driveway/sidewalk, and trash collection. The Corporation can also contract for exterior repair/replacement of structures and bill the cost as an assessment. You are responsible for maintaining the appearance of your home's exterior and for interior upkeep.
- Assessments & fees: Annual and special assessments are set by a majority vote of lot owners (one vote per lot). Assessments are uniform for all lots. If unpaid, a late fee applies after 25 days, and the Corporation may suspend services or file a lien. Assessments are subordinate to first mortgages.
- Architectural review: No exterior changes — including fences, walls, color, grade, or drainage — may be made without written approval from the Declarant or its Architectural Review Committee. Submit plans 10 days before a committee meeting; if no decision in 30 days, approval is deemed given. Rejected requests can be appealed to the Board of Directors.
- Pets: Maximum of two common household pets (dogs, cats, etc.) per dwelling, kept inside. No commercial breeding. Pets must be leashed on common areas and waste must be cleaned up promptly. Habitually noisy or unsanitary animals can be required to be removed.
- Parking & vehicles: No unusual vehicles (boats, trailers, aircraft, commercial vans, buses, immobilized vehicles) may remain on the property. Pick-up trucks are allowed. All resident vehicles must be parked overnight in designated parking spaces. Temporary parking is allowed only between dawn and midnight on an intermittent basis.
- Party walls: Because these are townhomes, party walls exist between units. Repair and maintenance costs are shared equally by the owners who use the wall. Disputes go to arbitration (each party picks an arbitrator, the two pick a third; majority decision binds both).
