What Dragoon Mountain Ranch Unit III Property Owners Association, Inc.'s governing documents say
Dragoon Mountain Ranch Unit III is a single-family home property owners association (HOA) in Cochise County, AZ. These bylaws govern the association's internal operations—membership, board structure, meetings, and assessments—but do not contain the community's use restrictions (like architectural rules or pet limits), which are in a separate Declaration of Covenants, Conditions and Restrictions.
- Association structure: The association is a non-profit corporation. Its primary purpose is maintaining and improving certain roadways within the subdivision.
- Membership & voting: Each parcel owner is a member with one vote per parcel. If multiple people own a parcel, they are treated as one member with one vote. The developer gets 7 votes per parcel it owns (3 votes for special assessments). Voting can be in person or by proxy (valid up to 11 months, revocable).
- Board of Directors: The Board consists of 1 to 5 owners, elected annually. Members can vote cumulatively. Directors serve one-year terms. A director can be removed only if at least 80% of ownership votes for removal.
- Assessments: The Board can levy annual and special assessments on members, but amounts must be 'reasonably necessary' as determined by the Board to meet the association's needs.
- Meetings & notices: Annual membership meetings are held, and special meetings may be called by a majority of the Board or by members holding 1/4 of total votes. Board meetings require at least 5 days' notice unless waived.
- Amendment of bylaws: Bylaws can be amended or repealed by a two-thirds vote of the total votes cast. Certain provisions (Article III paragraphs 1, 2, 4 and Article VII) require a two-thirds vote of the entire membership.
- What this document doesn't cover: These bylaws do not contain restrictions on property use, such as leasing, pets, parking, architectural review, or age limits. Those rules are in the separate Declaration of Covenants, Conditions and Restrictions, which is not provided here.
