What Oakleaf Village Property Owners Association's governing documents say
Oakleaf Village is a standard community with a homeowners association (HOA) in Jacksonville, FL. This declaration of covenants, conditions, and restrictions (CC&Rs) creates a master association (OakLeaf Village Property Owners Association) that covers both single-family lots and multi-family building sites. It applies to property owners within the development, including those in possible future sub-associations for attached homes.
- Assessments & dues: All owners (except the developer) pay annual and special assessments levied by the association. Annual assessments start at $50 per 'Assessment Equivalent' — one per single-family lot or per residential dwelling unit on a building site — and can increase up to 10% each year (or more with board vote). Assessments fund common area maintenance, insurance, utilities, reserves, and other association expenses.
- Leasing & rentals: The declaration does not set a minimum lease term, but the association reserves the right to adopt rules governing leasing. No specific restrictions appear in this document beyond possible future rules.
- Pets: This document does not mention any pet limits, types, or restrictions.
- Architectural review: No landscaping, building, fence, wall, or other exterior improvement may be constructed or altered without written approval from the developer (or later the association's architectural review board). Plans must be submitted for review; approval or denial must come within 30 days. The developer can require construction deposits and charge review fees.
- Use restrictions: All owners must comply with the Development of Regional Impact (DRI) and Planned Unit Development (PUD) orders, all environmental laws, and any rules the association adopts. Drainage flows may not be obstructed. The association can fine owners up to the maximum allowed by law for violations, with a hearing process.
- Developer rights & future changes: The developer retains broad powers — to add or withdraw land from the declaration, amend provisions (until it owns no land), grant variances from architectural rules, and impose additional restrictions. The declaration runs for 50 years and auto-renews for 10-year periods unless two-thirds of owners vote to change it (with developer consent if still owning land).
- Stormwater & wetlands: The association must maintain the stormwater management system per permits. Owners bordering jurisdictional wetlands or conservation areas must maintain them to permit conditions and indemnify the developer/association if violations occur. No one may alter drainage flow without regulatory approval.
- What this document doesn't cover: This is only the master declaration; it does not include specific rules for the use of common amenities (pools, clubhouses, parks), parking regulations, trash/recycling details, holiday decorations, or sub-association (townhome/condo) rules. Those may be in separate governing documents or future rules.
