What The Oaks Master Property Owners Association, Inc.'s governing documents say
This is the Bylaws of The Oaks Master Property Owners Association, Inc., a master-planned HOA in Kissimmee, FL. The document governs how the association is run—elections, meetings, board powers—but does NOT contain the community's use restrictions (those are in a separate Declaration). Owners of lots in this master-planned community are members of the association.
- Meeting notice & quorum: Annual meetings must be held within 13 months of the previous one; written notice must be mailed at least 15 days before. A quorum is 1/10 of the total membership votes.
- Board of Directors: size & election: The board has 3 to 9 directors (they need not be members). Directors are elected by members to staggered three-year terms; a majority of directors constitutes a quorum.
- Powers of the Board: The board can adopt rules, suspend recreational facility access for up to 60 days for rule infractions (and for non-payment of assessments), employ a manager, levy assessments as provided in the Declaration, and enter lots for maintenance if the owner fails.
- Assessments & delinquency: Each member must pay annual and special assessments. Unpaid amounts are delinquent after 30 days, bear 10% annual interest, and the association may foreclose or sue for payment plus costs and attorney's fees.
- Member rights & records: Any member may inspect the association's books, records, Declaration, Articles, and Bylaws. The association must provide current governing documents and the latest financial statement to prospective purchasers.
- Amendments: Bylaws may be amended by a majority vote of owners; FHA/VA can veto amendments while a Class C membership exists.
- What this document doesn't cover: This is only the Bylaws. The community's use restrictions—such as rules on pets, leasing, parking, architectural review, and age restrictions—are in the separate Declaration. This document also does not specify assessment amounts, reserve funding, or lot-maintenance obligations.
