What Terreno Homeowners Association, Inc.'s governing documents say
This is an amendment to the Declaration of Covenants, Conditions and Restrictions for Terreno, a single-family homeowners association in Naples, Florida. It updates the rules primarily around stormwater maintenance obligations on the developer and the HOA, and sets new leasing restrictions. This document is partial—it only amends Section 2.8 (developer/stormwater agreement) and Section 12.4 (leasing) of the full declaration, and also includes the HOA's architectural review application, construction standards, and after-market construction addendum.
- Stormwater maintenance obligation: The HOA and developer are jointly and perpetually responsible for operating and maintaining a shared stormwater management system (including manholes, pipes, lakes, and discharge points) serving the community and future Randall Boulevard widening. The developer may assign its obligations to the HOA. Inspections by a certified engineer are required every five years after completion, with reports forwarded to Collier County.
- Future road widening & access restrictions: Collier County intends to widen Randall Boulevard along the community's south boundary without compensating the HOA or developer. The HOA and developer may not request a traffic signal at the easternmost community access point (expected to be right-in/right-out/left-in after widening). No sound wall or noise barrier will be constructed or funded by the county.
- Leasing restrictions: Only entire units may be leased. The minimum lease term is 90 consecutive days. No unit may be leased more than three times in any calendar year. Leases must require tenants to abide by all HOA governing documents, and violations may be enforced against the tenant or owner, including attorney fees and costs secured by a lien.
- Architectural review process: Exterior modifications (landscaping, fences, paint, driveways, patios, swimming pools, screen enclosures, solar panels, etc.) require prior written approval from the Architectural Review Committee (ARC). Applications must include site plans, material samples, contractor licenses/insurance, and deposits. No work may start before written approval; fines of $100/day apply for starting without approval. Work must begin within 60 days of approval and be completed within one year.
- Construction deposits & fees: For pool/spa installations: $1,000 refundable deposit from owner (for common area damage), $5,000 refundable deposit from contractor, and a nonrefundable $1,000 fee from the contractor for use of cement clean-out and common area damage. For other material changes: a refundable deposit at the board's discretion. Deposits are returned after association manager confirms restoration of roadways and landscaping.
- Construction standards & restrictions: Working hours: Monday–Saturday 7:00 a.m.–7:00 p.m., no work Sundays or holidays. Speed limit 25 mph. No fires, no reflective window coverings, no walls on any parcel. All aluminum framing for screen enclosures must be bronze. Contractors must use HOA-approved irrigation company for modifications. Silt fencing required during construction. Contractors who damage property or dump materials may be fined $1,000 per incident and banned from future work.
- After-market construction addendum requirements: Owners and contractors must sign an addendum before work begins. Key requirements: contractor must notify HOA two days prior, keep site clean, cap irrigation lines under pool/enclosure, restore entire lot grade and lake bank, and use association-approved landscaper. Pool equipment must be screened by hedges (30” high at installation, maintained at 42”). Pool heaters may not exceed 48 inches. Neighbor permission required for access through adjacent properties.
- What this document doesn't cover: This document is an amendment plus attachments; it does not contain the full set of HOA rules. It omits topics such as: any age restrictions, parking rules, pet limits, noise regulations beyond construction, trash/recycling policies, use of common areas (if any), annual dues or assessment amounts, meeting and voting procedures, or enforcement procedures beyond fines and liens mentioned for leasing. Those would be in the original Declaration and other governing documents.
