Lake Talia is a single-family home HOA in Oldsmar, FL. These documents are the community's main rulebook (the Declaration of Covenants, Conditions and Restrictions) and a subsequent amendment that adds detailed leasing rules. They bind home owners (not renters directly) and cover what owners must maintain, how they may use their property, and what is required when renting a home.
- What you own & maintain: You own your lot and dwelling; you must maintain the roof, gutters, lawns, landscaping, walks, fencing, exterior surfaces, windows, doors, driveways, and all other exterior improvements on your lot. The Association maintains the common areas (entry area, drainage structures, ponds, private park) and any private streets, street lights, sidewalks, fences, and walls built as subdivision improvements.
- Leasing & rentals: All leases must be for at least one year and in writing. No home may be leased more than twice in a calendar year (unless the Association approves a hardship). The owner must submit a copy of the lease and an application signed by both owner and tenant at least 7 days before the term starts, pay a $50 lease application fee (adjustable by the Board), and provide a $250 security deposit to the Association. The Association may conduct background checks on adult tenants at the owner's expense. The tenant must agree to follow all HOA rules, and the owner must evict a tenant who violates them. Maximum tenant occupants: no more than 2 persons per bedroom (including overnight guests and professional caregivers). While a home is leased, the owner gives up their right to use the common areas — that right goes to the tenant.
- Architectural review: Before you build, alter, fence, paint, add a shed or solar collector, install a flagpole, antenna, or any other exterior change, you must get written approval from the Architectural Committee (initially the Declarant, later a committee of the Association). The Committee may adopt Design Standards. Fences are limited to 6 feet tall, white PVC lattice or ornamental style only, and no fences are allowed in front of the front setback line.
- Pets: You may keep up to two dogs and two cats (or other conventional household pets) per lot, but no commercial breeding. Pit Bulls, Rottweilers, or other breeds that insurance carriers list as high risk or uninsurable are prohibited. Pets must be leashed when outside the lot, cannot run at large, and you must clean up waste immediately. No outdoor animal pens, cages, or shelters are allowed without approval, and pets cannot be kept outdoors overnight.
- Parking & vehicles: No commercial vehicles, boats, trailers, recreational vehicles, inoperative vehicles, or machinery may be parked or stored on any lot, sidewalk, or common area. Permitted vehicles (passenger cars, vans, motorcycles, pickup trucks that fit inside a standard garage) may be parked in driveways provided they have a current tag and are in daily use. No major repairs may be done on a lot except inside a garage.
- Signs & flags: No signs, flags, banners, or similar items may be displayed without Architectural Committee approval, except: portable, removable flags no larger than 24" x 36" displayed on Armed Forces Day, Memorial Day, Flag Day, Independence Day, and Veterans' Day; and U.S. flags (subject to height/size limits per Florida law). In-ground flagpoles must be portable, must not exceed 20 feet, and require prior written approval. For-sale and for-rent signs must be obtained from the Association.
- Assessments & fees: All lot owners must pay annual assessments, special assessments (with membership vote for increases over 115% of the prior year), and specific assessments. The initial annual assessment was capped at $800 per lot, payable quarterly, and is subject to annual adjustment by the Board. Upon sale, a new owner must pay a working capital special assessment of up to six months' estimated regular assessment. Unpaid assessments become a lien on the lot and may be foreclosed.
- Use & activities: Lots may be used only for single-family residential purposes; no trade, business, or profession may be conducted (except Declarant's development activities or a home occupation approved by Pasco County). No obnoxious noises, odors, or nuisances are allowed. Trash containers may be placed curbside no more than 24 hours before scheduled pickup.
