Luna Plantation is a single-family residential subdivision in Tallahassee, FL, governed by a property owners' association. The rules bind all lot owners and are designed to maintain a low-density, rural-suburban character.
- Land use & lot size: All lots must be used for single-family residential purposes only. Each residence must sit on at least 1.5 acres, and no dwelling can be under 1,800 square feet of heated area (excluding porches and garages).
- Leasing & rentals: Short-term rentals—defined as leases under six months—are prohibited. All residential leases must be for six months or longer.
- Architectural review & building rules: Construction plans and site plans must be approved by the Association's Board of Directors before building. Minimum setbacks: 20 feet from property lines and 100 feet from Lake Iamonia's high-water line. Guest houses are capped at 1,200 square feet (one per lot). Outbuildings must be behind the front wall of the primary residence; pole barns with metal roofs are allowed. Fences can be brick, wood, iron, or metal; chain link and wire fences are banned except for animal enclosures. Docks are permitted but must include reflectors.
- Animals & pets: Ordinary household pets (e.g., dogs and cats) are allowed, but not for commercial breeding. Horses are permitted at a limit of one horse per acre (or fraction of an acre) owned; no other livestock or poultry may be raised or kept.
- Property maintenance & junk: Lots must be kept free of rubbish and junk (e.g., junk cars, old appliances). Grass must be mowed, shrubbery trimmed, and areas visible from the main road kept neat. Campers, RVs, and similar vehicles must be stored behind the front line of the primary residence, in the least-visible location. Boats cannot be stored in front of the primary residence or guest house.
- Assessments & fees: Annual assessments are levied per acre. In 1994, the rate was $100 per acre. Annual increases are capped at 10% unless approved by a majority of owners at a meeting. Special assessments require a majority vote. Voting power is proportional to lot acreage (one vote per acre).
- Prohibited structures & uses: No trailers or mobile homes are allowed. No noxious or offensive activities are permitted. Lots cannot be used as dumping grounds, and all waste storage must remain sanitary.
- How the rules can be changed: These covenants run for 10-year periods (renewing automatically) and can be amended by a majority vote of the total acreage of lots at a properly noticed membership meeting. Amendments can be proposed by the Board or by a petition signed by at least 10% of total lot acreage.
