What Planters Homeowners Association, Inc.'s governing documents say
This is the complete governing document for Planters Subdivision, a standard single-family-home HOA in Cartersville, Georgia. It establishes the HOA (Planters Homeowners Association, Inc.) which all lot owners are required to join, creates an Architectural Control Committee (ACC) with broad design approval authority, and sets out maintenance obligations, assessments, and use restrictions that apply to every lot and homeowner.
- Architectural review (ACC): All exterior construction, alteration, or landscaping (including fences, driveways, pools, sheds, color changes, and even mailboxes) requires prior written ACC approval. Plans are deemed approved if the ACC doesn't act within 45 days. The ACC can approve or deny based on any grounds, including purely aesthetic ones.
- Assessments & fees: Annual assessments begin at $250 per lot and can be increased only by a 2/3 vote of each membership class. Special assessments for capital improvements also require 2/3 approval. Assessments are due as set by the Board; unpaid amounts accrue interest and become a lien on the lot.
- Use restrictions: Lots are for single-family homes only; no commercial, business, or professional use allowed. No 'nuisance' activities, unreasonable noise, or accumulation of rubbish. No outside clotheslines, no exposed above-ground fuel/water tanks, and no on-street parking except for occasional events.
- Parking & vehicles: Recreational vehicles, trailers, boats, and work vehicles must be parked in garages or screened from street view. No tractor-trailer trucks except for deliveries. No inoperable vehicles allowed on a lot for more than 60 days. Vehicles over 40 feet may not be parked in the subdivision.
- Pets: Animals are allowed only as household pets and not for commercial purposes. No structure for animal housing may be built without ACC approval.
- Signs: Signs generally require ACC approval. One 'For Sale' or 'For Rent' sign up to 4 square feet is allowed. Temporary signs no larger than 30" x 30" (e.g., for yard sales or political signs) are permitted. Developer and builder signs are allowed during construction.
- Fences & walls: Fences and walls must complement the house design, colors, and materials; maximum height is 6 feet above grade; fence posts must be on the inside. No fence may be located closer to the street than the rear corner of the house, except for specific lots listed in the declaration.
- Minimum construction standards: Single-family homes must have at least 1,400 square feet of heated living area (1,500 for 1.5-story, 1,600 for 2-story). Minimum roof pitch is 7/12. Houses must have a double-enclosed garage. No prefabricated or factory-built structures are allowed. At least 50% of the front of the house must be brick or stone.
