The Vineyard at Yukon is a single-family-home homeowners association (HOA) in Gilmer County, Georgia. This declaration is the main rulebook for the community — it applies to every lot owner, occupant, tenant, and guest. It describes what owners are required to do and pay, and it does not, at this time, opt into the Georgia Property Owners' Association Act.
- What you own & maintain: You own your lot and the residence on it. You must maintain your entire lot (structures, landscaping, parking areas) to the 'Community-Wide Standard.' The association maintains the Area of Common Responsibility — entry features, gates, streets, common green spaces, and any amenities (like pavilions) — but is not responsible for the private water system.
- Assessments & fees: Each lot pays an equal share of common expenses. Assessments are set by the board annually, and cannot be withheld for any reason. Delinquent assessments accrue 18% annual interest and a 10% late fee. A new owner pays a one-time Working Capital Contribution (initially $350, adjustable up to the annual assessment amount). A foreclosure buyer owes a separate $1,000 Foreclosure Administration Fee. Special assessments over $500/lot/year require a majority owner vote.
- Architectural review: No exterior change — constructing a residence, making any exterior alteration, or placing any object that affects the lot's exterior appearance — is allowed without prior written approval from the Declarant (during its control period) or the Architectural Control Committee / Board. The ACC may charge a review fee and professional consultant fees. Design guidelines may change at the Declarant's discretion during the Declarant Control Period.
- Leasing & rentals: An owner in good standing may lease their residence. Short-term rentals (e.g., Airbnb, VRBO) are permitted. Guest houses may not be rented separately from the main residence. The board may require copies of leases and charge an annual lease administration fee as a specific assessment.
- Pets: Only usual household pets (dogs, cats) in a 'reasonable number' as determined by the board are allowed. Dangerous dogs are banned. Pets that endanger health or create a nuisance may be removed on 7 days' notice (or immediately if an urgent threat). Owners must promptly remove pet feces. The board may impose additional breed, number, or size restrictions.
- Parking & vehicles: Vehicles may park only in garages, driveways, or board-authorized spaces — never on grass or landscaped areas. UTVs/golf carts are permitted on community roadways only, must be stored in a garage, and cannot be driven on walking trails. ATVs are prohibited from being operated but may be stored inside a garage. Disabled, stored, or commercial-looking vehicles, boats, trailers, RVs, and full-size vans are banned from parking in the community (except in garages). Violating vehicles may be towed or booted after 24-hour notice (or immediately if blocking access or creating a hazard).
- Use restrictions & conduct: Lots are for residential use only. Limited home-based business is allowed if undetectable from outside and consistent with the residential character. No subdivision of lots, but two adjacent lots may be combined with board approval. No camping except back-yard tent camping for up to 3 consecutive nights. No above-ground swimming pools (except temporary infant wading pools). No yard sales more than once per 3 months. No gun display or recreational discharge on common property. Lot owners must keep their property free of rubbish, unsightly conditions, and drainage obstructions. Tree clearing is limited to 45% of trees 10 inches or more at base diameter.
- Construction & building standards: Each residence must have a minimum finished heated and cooled area of 1,200 square feet (with at least 800 sq. ft. on the first floor). Mobile homes, modular homes, and tents (except short-term recreational camping) are prohibited. Exterior construction must be completed within 1 year of start. Minimum lot setbacks: front 25', rear 40', side 20' (unless otherwise approved). No more than one outbuilding per lot; guest houses are allowed only on lots of 3 acres or more and must be at least 800 sq. ft.
