What Hickory Grove Estates's governing documents say
Hickory Grove Estates is a single-family-home subdivision in Peoria County, Illinois. All lots in this community are subject to a set of restrictive covenants that run with the land. This document creates the basic rules for the subdivision and provides for the formation of a homeowners association, though the association had not yet been formed at the time this was recorded.
- Allowed use: All lots may be used only for single-family residential purposes.
- Architectural review: Before starting any construction, alteration, or placement of a building, you must submit plans and specifications to the original developer (Subdivider) for written approval. The Subdivider has 30 days to approve or disapprove; if no action is taken within 30 days, or if no lawsuit is filed to stop construction before it's finished, approval is no longer required.
- Construction standards: Dwelling houses cannot exceed 2.5 stories in height. Each house must have an attached, enclosed garage that can hold 2 to 4 cars. Garbage or trash cans must be recessed into the ground with a permanent lid or otherwise hidden from view. Permanent outdoor clotheslines are not allowed. Each house must have a freestanding lamp post (approved by the Subdivider) located 15 feet from and parallel to the curb, with an automatic dusk-to-dawn light; the homeowner must maintain it. A mailbox of approved design must be installed and located per USPS regulations.
- Build-out deadline: Construction of a dwelling house must begin within 4 years of buying the lot and must be completed within 1 year of starting. If construction hasn't started, the Subdivider can repurchase the lot at the original purchase price. If construction starts but isn't finished within a year, the Subdivider can repurchase the lot at the original price plus 90% of the fair market value of the partially built house.
- Homeowners Association: The document provides for a future Home Owners Association to be formed (once the developer decides and at least 50% of lots are sold). Once formed, the Association will be managed by three Trustees (lot owners elected for one-year terms). The Association may adopt bylaws, create a general fund, enforce restrictions, and collect assessments. Assessments (including fire hydrant rentals) can become a lien on the lot if unpaid.
