Wexford Crossing is a condominium community in Madison, WI — you own your unit and share ownership of the common elements, which the association maintains and insures. This document is the Declaration of Condominium, the core rulebook that defines your rights and responsibilities as a unit owner.
- What you own & maintain: You own the interior of your unit (including appliances, fixtures, and attached garage if any) and are responsible for its decoration, furnishing, housekeeping, maintenance, repair, and replacement. The association maintains the common elements (land, building structure, shared spaces) and limited common elements (patios, balconies, one parking space) are your responsibility for cleanliness and presentability.
- Leasing & rentals: Leases must have an initial term of at least six months — no short-term or transient rentals. Leasing for residential purposes is allowed, but you cannot use the unit for any trade or business.
- Assessments & fees: You must pay monthly assessments (common expenses) based on your unit's percentage share. Assessments are due in advance, and the budget includes reserves for deferred maintenance and replacement. Special assessments may be levied for unplanned items. Unpaid assessments become a lien on your unit and can lead to foreclosure.
- Structural changes & alterations: You may make interior improvements that don't impair structural soundness, reduce value, or impair easements. Changing the exterior appearance of your unit or any common element requires written permission from the association board. Changes to floor plans or room dimensions require recording a plat modification.
- Insurance: The association carries property insurance on common elements (including limited common elements) and liability insurance with at least $1,000,000 in coverage. You should maintain your own insurance for your personal property, unit, and limited common elements.
- Use restrictions: Units, limited common elements, and common elements are for residential use only — no trade or business. No storage or activity that increases insurance rates. You must comply with Madison ordinances, association bylaws, and rules. No use may unreasonably interfere with other owners' enjoyment.
- Voting & association control: Each unit gets one vote in the association. The declarant (developer) controls the association until 2 years after the declaration is recorded or until 75% of common elements are sold to purchasers, whichever comes first. After that, control transfers to unit owners, though the declarant may name one board member until all units are sold.
- Right to expand: The declarant may add up to 90 additional units within 5 years of recording this declaration. Expansion changes your percentage interest in common elements, common expense liability, and voting rights as specified in the amendment.
