- Prior written approval of Committee required for: any dwelling, building, structure, improvement of any type or kind, repainting, removal of existing trees. Also for fences, outdoor light fixtures, basketball goals, and similar structures. (Section 7.A(i), Section 3.C, Section 6.M)
- Setbacks / home size
- Residential setbacks shall be as indicated on the final plat in accordance with applicable zoning ordinances and zoning variances obtained. (Section 3.B)
- Maintenance
- Owner is responsible for maintenance of the Lot and all improvements on it. No homeowners association or common area maintenance is provided for in this Declaration. Party wall maintenance shared equally among owners who use the wall. (Section 3.I, Section 5.B)
- Use restrictions
- Every lot used exclusively for single-family residential purposes. Permitted: one detached single-family dwelling, one attached dwelling as part of a duplex on two adjoining lots, or one attached as part of a triplex on three adjoining lots (Section 2.A)
- Voting & meetings
- After all lots have completed residences, Committee members selected by written approval of at least 66 2/3% of Owners; vacancies filled similarly or by remaining members until regular vote (Section 7.E)
- Amendments
- Initial term 20 years, auto renews 10 years in perpetuity. Termination requires vote of 90% of Lots and 90% of Mortgagees. Developer reserves right to amend to comply with public agency or mortgage insurer requirements while Developer owns (Section 12)
