Lafayette Falls is a standard single-family homeowners association (HOA) in South Bend, Indiana. These Rules and Regulations supplement the community’s Covenants and Bylaws and apply to all homeowners, their tenants, and guests. Owners are responsible for their tenants' compliance, and tenants must be given a copy of these rules before moving in.
- Leasing & rentals: Owners who rent their home must provide the Board with the tenant’s name, address, and phone number, plus the owner’s emergency contact, within 10 days of the start of tenancy. The owner remains fully responsible for all fees, dues, fines, and the tenant's compliance with these rules.
- Parking & vehicles: Recreational vehicles, boats, campers, trailers, and commercial trucks may not be stored in the area for longer than three consecutive days (Friday through Sunday). On Monday through Thursday, any such vehicle is a violation. Non-operable vehicles (e.g., missing a tire or without current registration) may not be parked or stored outside an owner's garage and may be towed at the owner's expense. Minibikes, go-carts, golf carts, and similar motorized vehicles are not allowed on non-public roads.
- Pets: Each home may have no more than three domesticated pets. Dogs must be leashed by a capable adult when outside the owner’s property. Livestock and poultry are prohibited. Patios and yards may not be used as living areas for pets, and continuous barking is not allowed. Owners must clean up animal waste immediately, including in common areas.
- Exterior modifications & ACC approval: All exterior changes to structures or grounds require advance written approval from the Architectural Control Committee (ACC) and the Board. Plans and engineering drawings must be submitted. Fencing must be white PVC or similar; wood or metal fences need unanimous ACC approval. Perimeter fencing may not exceed 4 feet; privacy fencing around a patio may be up to 6 feet. Water Feature homes (lots with a “W” prefix) are not allowed any fencing in the back yard. Exterior clotheslines are prohibited.
- Noise & nuisances: Excessive noise and loud music are prohibited. No noxious or offensive activity may be carried on, and no commercial, business, or professional office use is allowed on residential home sites (except by the developer or builders). Parents are responsible for ensuring juveniles do not disturb other residents.
- Trash & refuse: All trash and recyclables must be placed in covered City-provided bins. Bins must be stored in a garage or shed, or otherwise not visible from the street, except on collection days. Bins must be removed from the street or alleyway within 24 hours of collection.
- Fines & enforcement: Violations are handled through a graduated fine schedule: a first notice gives 10 days to resolve; then a $50 fine; a second $200 fine at 20 days; and if unresolved after 30 days, an additional $200 fine and possible lien. Fines of $200 may continue every 20 days up to a maximum of $10,000. Repeat violations start with a $100 immediate fine.
- Undeveloped lots: Owners of undeveloped lots must maintain them by mowing fully every June and September, and mowing at least 15 feet back from the street every 2–3 weeks between June and September. No items may be placed or stored on these lots without Board approval.
