Comotara Homeowners Association is a standard single-family HOA in Wichita, Kansas. It is owned by individual lot owners (and may include condominium or cooperative units within the property). These bylaws govern the corporation's structure—membership, board of directors, officers, meetings, and voting—not day-to-day homeowner rules.
- Membership & who votes: All lot/unit owners are automatically members. Each member gets one vote per unit owned; co-owners of a single unit share one vote. If co-owners cannot agree how to cast that vote, the vote is not allowed. Owners who are violating HOA restrictions or who have unpaid dues or assessments cannot vote.
- Meetings of members: Annual meetings are held on the second Thursday of January at 6:00 PM. Special meetings can be called by the president, a majority of the board, or by a written request of at least 20% of eligible members. Notices must be mailed at least 10 but no more than 150 days before a meeting. A quorum is any members present at a duly-called meeting.
- Board composition & elections: The board has between 1 and 11 directors, each serving a one-year term, elected at the annual members' meeting. Directors must be HOA members. A majority of directors constitutes a quorum; decisions require a majority vote of those present.
- Board meetings & compensation: Annual board meeting is the second Thursday of February at 6:00 PM. Regular meetings are announced via signs, phone messages, and electronic means. Directors serve without salary but may be excused from HOA fees if they attend at least 4 of 6 meetings; otherwise they must pay all fees and lose voting privileges. Directors may receive reimbursement for meeting expenses.
- Architectural committee: The board appoints an architectural committee of three or more HOA members to serve at the board's pleasure. Specific rules about what requires approval or design standards are not in this document.
- Corporate governance & records: Members may inspect bylaws, membership lists, books of account, and board meeting records for a 'proper purpose' related to their interest as members, upon written demand under oath. The board can amend the bylaws on its own (unless stated otherwise).
- What this document doesn't cover: These bylaws do not cover pet rules, leasing restrictions, parking, architectural design standards, assessment amounts, or common area maintenance responsibilities.
