This is the governing legal document for The Oaks Condominium at The Woodlands, a Massachusetts condominium community in Clinton. It sets out the rights and responsibilities of unit owners in a phased, multi-building development (starting with 12 units in four buildings) that is also part of the larger Woodlands planned community.
- What you own & maintain: You own the interior of your unit (floors, interior walls, ceilings) and any appurtenant limited common areas like a patio/deck or a 20-foot rear yard. The association maintains the common elements (foundations, structural walls, roofs, common areas, and utility infrastructure). Unit owners must maintain their patios/decks and rear yards and keep them clean.
- Leasing & rentals: Leases are allowed but must comply with this Master Deed, the Condominium Trust, and any rules. A copy of each written lease must be filed with the Trustees. There is no minimum lease term stated in this document.
- Pets: No more than two common household pets (dogs, cats, etc.) per unit. No livestock or poultry. Pets must be leashed when outside the unit. Pets that are a nuisance may be removed by the Trustees if the owner fails to act.
- Architectural review: No exterior changes (porches, decks, awnings, signs, storm doors, antennae, painting, etc.) without written approval from the Trustees and Architectural Review Committee. Interior remodeling is allowed but requires prior approval of plans if it affects structural integrity; failure to act within 45 days is deemed approval.
- Parking & vehicles: Each unit has an exclusive parking space (typically in front of the garage or unit). Parking is for registered, licensed, operable passenger vehicles only. Trucks, boats, trailers, and other vehicles are prohibited without Trustee permission. Unassigned parking becomes common area when the developer no longer owns any units.
- Home businesses: No trade or business may be conducted in or from a unit unless it is not detectable from outside, complies with zoning, does not involve non-resident visitors or solicitation, and is consistent with residential character. Leasing is not considered a business.
- Noise & nuisance: No nuisance or offensive use is allowed. Units with hard flooring (wood, tile, stone, etc.) above another unit's living area must cover at least 70% of the floor area in each room with a carpet and pad to reduce noise. Exceptions for health reasons must be corrected before transfer.
- What this document doesn't cover: This Master Deed does not include the full rules and regulations of the condominium trust, the by-laws, or the separate Declaration of Covenants for the Woodlands Community Association. It also does not contain fee amounts, assessment details, or specific operational rules beyond those stated above.
