What Regency Heights Homeowners Association's governing documents say
This is a standard single-family homeowners association (HOA) declaration for the Regency Heights Seventh Plat subdivision in Independence, Missouri, covering Lots 164-197. It governs the owners of the individual lots, all of which must be used for single-family residences only.
- Use restrictions: Lots may only be used for single-family residences. No business, profession, or noxious activity is allowed on the property; no livestock, poultry, or pigeons may be kept; no more than one dog and one cat over 12 weeks of age per lot.
- Leasing & rentals: No rental property homes may be constructed, owned, or sold to any corporation or LLC within any plat of the association. Privately owned or existing corporation/LLC owned rental properties (including lots 242, 247, and 248) cannot be sold for use as rentals.
- Architectural review: All building plans, specifications, and site plans must be approved in writing by the Developer (initially) or the Architectural Review Board thereafter. Approval is not required if the board fails to respond within 60 days. Detailed plans including elevations, site plan, floor plan, exterior materials, landscape plan, and color samples must be submitted.
- Minimum size & appearance: Each single-family residence must have at least 1,400 square feet of total enclosed floor area. Thirty percent of the house front must be brick, stone, or stucco; roof pitch must be at least 7/12; shingles must be 30-year composition in Weathered Gray or approved; exterior paint must be earth tones or approved. Exteriors may not remain unfinished for more than nine months after construction starts.
- Fines & enforcement: Violations of appearance standards may result in fines of $1 to $500 per day. Unpaid fines become a lien on the property (subordinate to first mortgages). The developer, association, or any owner may enforce restrictions through injunction or damages, including attorney's fees.
- Parking & vehicles: No automotive equipment, trailers, campers, recreation vehicles, mobile homes, or boats may be stored outside of a residence. No automobile repair is allowed on lots. All vehicles must be restricted to streets and driveways at all times. Storage units, PODs, and roll-off dumpsters are limited to 30 days of use.
- Fences & pools: Chain-link fences are prohibited; all fence locations, heights, and materials require written approval (deemed granted if no response within 30 days). No fence may exceed 6 feet in height. Only in-ground swimming pools are allowed, must be placed to the rear of the residence, and require developer approval and enclosure fencing per city code.
- Assessments & membership: All lot owners automatically become members of the association. The initial annual assessment is $250 per lot, payable May 1. Assessments may be increased if actual expenses exceed that amount; unpaid assessments become a lien on the property, bear interest, and may incur attorney's fees.
