What Edgewater Townhomes Association Inc's governing documents say
Edgewater Townhomes is a townhome community in Apex, NC, governed by a homeowners association (HOA) that maintains the exteriors of the homes and common areas. This document is the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) that binds all owners and residents. It is part of a larger master-planned community, so there is also a master association with its own rules and fees.
- What you own & maintain: You own your townhome's interior, including HVAC, plumbing, and electrical systems. The association maintains the exterior of your home (roof, siding, landscaping, etc.) and all common areas, but you are responsible for your entry doors, windows, patio doors, and driveways beyond the garage door.
- Leasing & rentals: You may lease your townhome, but only as permitted by the association's rules and regulations. Tenants must follow all community rules, and owners remain responsible for their tenants' compliance.
- Architectural review: Any new construction, modification, or alteration to your property must be approved by the Architectural Control Committee (ACC) before you begin.
- Fines & enforcement: The association can fine you up to $150 per day for rule violations, suspend your voting rights and use of recreational facilities, and even suspend services if you are more than 30 days delinquent on assessments.
- Assessments & fees: You must pay regular and special assessments to the Edgewater Townhomes Association, in addition to separate assessments charged by the master association (Edgewater Community Association).
- Common area use: You have a right to use the common areas (like pools, parks, and trails) but the association can limit guests, charge fees, and suspend your access for unpaid fines or rule violations.
- Party walls: Walls shared between townhomes are party walls. You and your neighbor share the cost of repair and maintenance equally, and disputes are resolved through arbitration.
- What this document doesn't cover: This excerpt does not include specific rules about pets, parking, or age restrictions. Those may be covered in the association's Rules and Regulations or the master declaration.
