It establishes a homeowners association (HOA) that maintains common areas and the exterior of units, and it binds all lot owners, including future buyers and renters.
- What you own & maintain: You own your lot and the interior of your townhome. The association maintains the exterior of your unit (roof, gutters, painting, landscaping, grass, sidewalks, driveways) and all common areas, but you are responsible for windows, doors, decks, patios, and any fenced areas.
- Leasing & rentals: Renting your unit is allowed, but if you lease it, your voting rights are capped at 49% on association matters. Tenants may use common areas as their principal residence.
- Assessments & fees: Annual assessments are capped at $1,800 per lot for 2016, increasing by up to 10% each year. Special assessments require a two-thirds vote of Class A members. A working capital fee equal to one-sixth of the annual assessment is due at the initial sale.
