The association (the two unit owners together) manages the building, common areas, and master insurance. This document is the full Declaration of Condominium and Bylaws, so it covers ownership structure, use restrictions, assessments, and governance.
- What you own & maintain: You own your unit (approx. 1,785 sq ft, three stories) and a 1/2 undivided interest in common elements. You maintain your unit's interior and limited common areas (e.g., decks, patios, porches). The association maintains common elements (roof, exterior walls, party wall, structural parts, grounds) and exterior painting.
- Use restrictions: Units may be used only as residences by a family, servants, and guests. No business, industry, or profession is allowed. No single rooms may be rented — only entire units. No use that annoys residents or increases insurance rates is permitted.
- Leasing & rentals: You may rent your entire unit, but not individual rooms. The declaration does not set a minimum lease term, but the Bylaws require that no portion of a unit less than the entire unit may be rented.
- Pets: Pets are allowed only with written permission from the Board of Managers. Dogs must be on a leash or carried in common areas. Pets may be kept in limited common areas north of the southernmost driveway, restrained by an invisible fence if needed, and must not become a nuisance. Permission can be rescinded by either unit owner if the pet becomes a problem.
- Architectural review: No exterior changes (building, fence, wall, other structure, or exterior color change) may be made without Board approval. Exterior color changes require unanimous approval of both unit owners.
- Assessments & fees: The Board determines common charges annually. Each unit pays 1/2 of common expenses. Unpaid assessments accrue interest at the legal rate and create a lien on the unit. The Board may foreclose or sue to collect.
- Parking & vehicles: No boats, trailers, bicycles, or similar items may be left in common areas (they may be stored in limited common areas). Vehicles must not impede access to another unit. Owners must obey posted parking and traffic regulations.
- Governance & voting: The Board of Managers has two members (one per unit). Each unit gets one vote. Most decisions require unanimous consent of both unit owners (100% vote). The Bylaws require 100% quorum and 100% vote to amend the Bylaws.
