This document is an amendment to the master 751 South declaration, so it supplements—not replaces—the main community rules.
- What you own & maintain: You own your Brownstones lot and unit, but the association maintains the exterior of your unit (roof, gutters, exterior walls, walks, fences) and the front/rear landscaping. You're responsible for interior maintenance, glass, screens, exterior lights, and any landscaping beyond the basic package.
- Landscaping & yard access: The association mows, fertilizes, mulches, and edges your lawn. You must keep an unlocked rear yard gate so contractors can access fenced areas; if you lock it, the association isn't responsible for missed maintenance. You can't plant vegetation without approval, and unusual plants that need extra care may trigger an individual assessment.
- Party walls: Walls shared between attached units are party walls. Repair costs are shared proportionally by owners who use the wall, and disputes go to arbitration. You have an easement to access the adjoining lot for party wall construction or repair.
- Insurance: You must carry fire and hazard insurance covering full replacement value of your unit, including foundations. If you don't, the association can buy it and charge you. The association may also carry master casualty insurance, paid for through Brownstones assessments.
- Assessments & budgets: Brownstones expenses (landscaping, exterior maintenance, insurance, reserves) are paid through separate assessments on Brownstones lots. Budgets increasing assessments by 12% or less are ratified unless 90% of owners vote to reject; increases over 12% need a 2/3 vote. Special assessments for capital improvements require 67% approval. Initial buyers pay a capital payment equal to two months' estimated assessment.

Amendments to this article require 80% approval of Brownstones owners (plus Declarant during the control period), but the Declarant can unilaterally amend certain provisions without owner approval.
