Holly Pointe is a planned community of detached single-family homes and townhomes in Holly Springs, NC, governed by a homeowners association (HOA). The HOA maintains common areas and enforces rules, and all lot owners are automatically members. This document is the full declaration of covenants, conditions, and restrictions that applies to every property in the community.
- What you own & maintain: You own your lot and home; the association maintains common areas, including open space, stormwater systems, and any recreation facilities. If your lot has a greenway or common-area easement, you must maintain that area, and the association can enter to maintain it if you don't.
- Leasing & rentals: You may lease your home, but leases must be in writing, for at least six months, and must include a clause binding the tenant to the HOA rules. You must provide a copy of the lease to the association. If you lease your home, your vote on association matters is limited to 49% weight.
- Assessments & fees: The HOA charges annual assessments, initially capped at $800 per lot (until 2006), with annual increases limited to 10% unless approved by a majority vote. Special assessments for capital improvements require member approval. Unpaid assessments become a lien on your property and can be foreclosed.
- Architectural review: Any changes to your property, including structures, fences, or landscaping in easement areas, require prior written approval from the association. The declaration includes an architectural control article (Article VIII) that governs such approvals.
- Common area use & restrictions: Owners have a right to use common areas, but the association can suspend use for unpaid assessments (after 30 days) or rule violations (up to 60 days). You cannot remove trees, build structures, or place impervious surfaces on common-area or greenway easements without permission.
- Voting & membership: Each lot gets one vote, but the developer (Declarant) has three votes per lot until the Declarant Control Period ends (by 2015 or earlier). If you lease your home, your vote is limited to 49% weight on any matter.
