What Village at Arbor Creek Homeowners Association Inc's governing documents say
This is the master declaration for Arbor Creek, a planned unit development in Holly Springs, NC, with a master homeowners association and potentially multiple sub-associations. It applies to all property owners in the community, including those in single-family homes, townhomes, condos, and apartments. The document establishes the framework for the master association, assessments, architectural controls, and common area use.
- Community structure: Arbor Creek is a planned unit development with a master association (Arbor Creek Homeowners Association) and may have sub-associations for specific sections. Owners are members of both the master and any applicable sub-association.
- Assessments & fees: Owners must pay annual and special assessments to the master association and any sub-association. The maximum annual assessment increases automatically by up to 12% per year, and can be raised without limit by a two-thirds vote. Unpaid assessments accrue 18% interest and a $25 late fee, and can become a lien on the property.
- Leasing & rentals: Owners may lease their units, but leases must be in writing and must state that they are subject to the declaration and association rules. Unimproved lots cannot be leased.
- Architectural review: No building, fence, sign, mailbox, or other structure can be erected or altered without prior written approval from the Declarant or the Architectural Review Committee. Approval can be denied for any reason, including aesthetics. The Declarant has sole discretion over building location.
- Pets & animals: Dogs, cats, and other household pets are allowed, but not for commercial purposes. Animals cannot be chained or tied to inanimate objects, and must be controlled if they create noise disturbances.
- Property maintenance: Owners must keep their lawns and landscaped areas mowed and trimmed, and prevent unsightly or unsafe conditions. The Declarant can enter the property to correct violations after notice, and charge the owner for the cost.
- Common area use: Owners have an easement to use the common areas, but the association can charge fees for recreational facilities, suspend voting rights for unpaid assessments or rule infractions, and impose regulations. The association can also dedicate common areas to public agencies.
- What this document doesn't cover: This is the master declaration, so it does not include specific rules for individual sections (which would be in supplementary declarations) or the detailed bylaws of the master or sub-associations. It also does not state the current assessment amount or specific architectural guidelines.
