This document is the full declaration of covenants, conditions, easements, and restrictions (CC&Rs) that bind all lot owners, residents, and guests.
- What you own & maintain: You own your lot and the house on it. The association owns and maintains the common areas (e.g., roads, stormwater facilities, amenities) and limited common properties (e.g., driveways, walkways serving your lot). You are responsible for maintaining your lot and any improvements, and must prevent unclean or unsightly conditions.
- Assessments & fees: All lot owners pay annual assessments set by the board, which can increase up to 10% per year without a member vote (or up to $350 per lot initially). Special assessments for capital improvements require 67% member approval. A one-time working capital fee of $350 is due at purchase. Late payments incur a $20 monthly fee and can lead to a lien on the lot.
- Architectural review: Any exterior changes (construction, fences, landscaping, paint, etc.) require prior written approval from the Declarant (during developer control) or the Architectural Control Committee. Plans are deemed approved if no response within 30 days. Minimum heated floor area is 1,200 sq ft. Construction must be completed within 12 months (additions within 6 months).
- Use restrictions: Lots are for single-family residential use only. No businesses, noxious activities, or nuisances are allowed. Temporary structures, trailers, and mobile homes are prohibited. No boats, campers, inoperable vehicles, or off-road vehicles may be stored on lots or streets. Repairs must be done inside garages or out of sight.
- Pets: Household pets (dogs, cats) are allowed but must be leashed and controlled, not kept for commercial purposes, and not become a nuisance. No livestock or poultry.
- Leasing & rentals: The document does not specify minimum lease terms or restrictions on renting. Owners may delegate use of common areas to tenants, but tenants must comply with all rules.
- Stormwater & environmental rules: Each lot has a maximum built-upon area of 3,700 sq ft. Vegetated buffers, roof drain setbacks, and curb outlet swales must be maintained. Filling or piping of vegetative conveyances is prohibited. These covenants cannot be altered without state approval.
