What Sea Oats's governing documents say
Sea Oats is a residential community in North Topsail Beach, NC, governed by two sets of restrictive covenants. The first (1997) covers commercial lots in Coastal Village Section I, allowing only commercial uses. The second (1995) covers Emerald Dunes Village, a single-family residential subdivision with some duplex lots, and includes a private roadway maintenance assessment. These rules bind lot owners, not renters.
- Land use & building type: Coastal Village lots are restricted to commercial purposes only; no residential use. Emerald Dunes Village lots 1-9 are single-family residential; lot 10 may be a single-family or duplex. No mobile homes, trailers, or temporary structures are allowed.
- Minimum square footage: In Coastal Village, the ground floor area must be at least 1,000 sq ft for one-story or 800 sq ft for multi-story buildings. In Emerald Dunes Village, dwellings must have at least 1,800 sq ft (single-story) or 2,000 sq ft (two-story) of heated living area.
- Architectural review: All exterior construction, alterations, and landscaping in Emerald Dunes Village require prior written approval from the Declarant or Committee. Plans are deemed approved if not acted on within 30 days. The review considers aesthetics, harmony, and suitability.
- Pets: In Emerald Dunes Village, no more than two household pets (dogs, cats) are allowed, and they must be kept on a leash when outside. Livestock and poultry are prohibited. Coastal Village covenants also prohibit livestock and poultry except household pets.
- Parking & vehicles: In Emerald Dunes Village, no vehicles may be parked on streets. Trucks over one-ton capacity, boats, campers, and trailers must not be visible overnight. No junk or unregistered vehicles are allowed. Coastal Village prohibits junk cars.
- Private roadway assessments: Lots in Emerald Dunes Village that abut or use the private roadways are subject to special assessments for maintenance, repair, and capital improvements. Assessments are a lien on the lot and the personal obligation of the owner. Interest accrues at 12% per annum on delinquent amounts.
- Duration & amendment: Coastal Village covenants run for 25 years (from 1997), auto-renewing every 10 years unless a majority of owners agree to change. Emerald Dunes Village covenants run for 30 years (from 1995), auto-renewing every 10 years; amendments require 90% owner approval during the initial term, then 2/3 thereafter.
