What Saunders Village's governing documents say
Saunders Village is a planned community in Brunswick County, NC, governed by a Declaration of Covenants, Conditions, Restrictions and Easements (CCRs). This document establishes the community's rules and an association (Saunders Village Community Association, Inc.) that all lot owners automatically join. It applies to homeowners, residents, and their guests, and covers use of lots, common areas, architectural controls, maintenance, assessments, and insurance.
- What you own & maintain: You own your lot and the dwelling on it, and you are responsible for maintaining your lot, including landscaping, structures, and repairs. The association maintains common areas (e.g., roads, entry features, ponds, stormwater facilities) and may enter your lot to perform maintenance if you fail to do so, charging you for the cost plus 12% interest.
- Architectural review: No exterior changes (fences, landscaping, paint, etc.) may be made without prior written approval from the Declarant (D.R. Horton) or, after the Declarant Control Period, an Architectural Review Committee (ARC). The reviewer has sole discretion based on aesthetics, and decisions are not appealable if made in good faith. Approval expires if construction doesn't start within one year.
- Leasing & rentals: Leases must have a minimum term of six months. The association may regulate leasing but cannot prohibit it or require consent for a transfer. Owners must comply with all rules, and tenants are bound by the governing documents.
- Occupancy & use: Lots are for single-family residential use only. Occupants of a lot must be a single family (related by blood, marriage, adoption, or guardianship) or no more than three unrelated persons living as a single housekeeping unit. No mobile homes, manufactured housing, or temporary structures as residences are allowed.
- Parking & vehicles: Only licensed, operative passenger cars, station wagons, pickup trucks, or passenger vans may be regularly parked in driveways. No regular parking on roadways. Recreational vehicles must be screened from view, and no vehicle may be used as a dwelling.
- Pets & animals: The document does not specifically address pets or animals beyond general prohibitions on nuisances and offensive activities. Check the Rules and Regulations (Exhibit C) for any pet restrictions.
- Assessments & fees: The association levies annual Base Assessments equally on all lots to fund common expenses.
