It is not a full HOA rulebook; it only obligates the homeowners' association (Brinley Manor Homeowners Association Inc.) and lot owners to maintain stormwater control facilities, and grants the City of Raleigh inspection and enforcement rights.
- Stormwater maintenance responsibility: The HOA (or a commercial lot owner, if applicable) is responsible for maintaining the stormwater control facilities (a level spreader with vegetative filter strip) per the approved manual and budget. Each lot owner is jointly and severally liable for maintenance costs, with a right of contribution from other owners.
- Assessments & liens: The HOA may levy assessments for stormwater maintenance costs; unpaid assessments become a lien on the lot. If the City performs maintenance due to non-compliance, it can also levy assessments and place liens on delinquent lots.
