This is a maintenance covenant and protection easement for stormwater control facilities, required by the City of Raleigh for the Longleaf Estates single-family residential development. It binds the homeowners association and all lot owners to maintain the stormwater wetlands, and grants the city rights to inspect and enforce. It is not a full set of HOA rules.
- Stormwater facility maintenance responsibility: The Longleaf Estates Homeowners Association is responsible for maintaining the stormwater wetlands (at Drainage Points 1, 2, and 3) after the developer transfers them, per the approved operations and maintenance manual.
- Mandatory HOA membership & assessments: All lot owners must be members of the association, which can levy assessments for stormwater maintenance costs. Unpaid assessments become a lien on the lot.
- City enforcement & access rights: The City of Raleigh has permanent easements to inspect and, if needed, repair the stormwater facilities, and can charge owners for the work. The city can also levy assessments and pursue liens if costs aren't reimbursed.
- Insurance requirement: The responsible party must maintain liability insurance of at least $1,000,000 for the stormwater control facilities.
- Penalties for non-maintenance: Failure to maintain the facilities can result in daily civil penalties and other enforcement actions by the city, and owners are jointly and severally liable for maintenance costs.
