North Hills Place is a townhome community in Raleigh, NC, governed by a homeowners association (HOA). This document is the full set of covenants, conditions, and restrictions (CC&Rs) that apply to all owners and residents. It covers what you own, what the HOA maintains, and the rules you must follow.
- What you own & maintain: You own your lot and the townhome unit on it. The HOA maintains common areas, exterior building surfaces (including roofs and gutters), and front-yard landscaping. You are responsible for interior maintenance and any improvements not originally installed by the builder, unless the HOA agrees otherwise.
- Assessments & fees: All owners pay annual HOA assessments, which can be increased by the board up to 10% per year without a vote; larger increases require a two-thirds vote of members. Special assessments for capital improvements also require member approval. Unpaid assessments become a lien on your property and can accrue interest up to 18% per year.
- Leasing & rentals: Owners may lease their units, but the declaration does not specify a minimum lease term. However, if a unit is leased, the owner's voting rights are limited to 49% on any association matter.
- Pets: You may keep a reasonable number of cats, dogs, and other household pets, but they cannot be bred or kept for commercial purposes. Pets must be leashed when outside, and you must clean up after them. No animals are allowed on common areas except as permitted by HOA rules.
- Parking & vehicles: Street parking is only allowed in designated paved spaces. You cannot park abandoned, inoperative, or commercial vehicles, boats, RVs, or trucks over one ton on your lot or on streets. The HOA can tow violating vehicles at your expense.
- Architectural review: Any exterior changes, including fences, additions, or major landscaping, require written approval from the HOA's Architectural Committee before starting. The committee has 30 days to respond; if they don't, approval is deemed given.
- Use restrictions: Lots are for residential use only; no commercial activity is allowed without a city permit. You cannot display signs except for one 'For Sale' sign in your front yard or a small 'For Rent' sign in a window. No nuisances, outside clotheslines, or vehicle repairs in public view are allowed.
