What North Ridge Condominiums's governing documents say
North Ridge Condominiums is a condominium community in Raleigh, NC, established in 1975 under the North Carolina Unit Ownership Act. This declaration governs the original Phase One (20 units in three buildings) and outlines the rights and responsibilities of unit owners, including shared ownership of common areas, assessments, and use restrictions. It is the foundational rulebook for anyone owning or living in a unit here.
- What you own & maintain: You own the interior of your unit (defined by interior surfaces of perimeter walls, floors, and ceilings) and an undivided percentage interest in common areas (land, structural elements, roofs, exterior walls, and shared systems). The association maintains common areas and carries master insurance; you maintain your unit's interior and personal property.
- Assessments & common expenses: Each unit pays a share of common expenses (including insurance, maintenance, and recreational facility costs) based on its percentage interest in common areas. Unpaid assessments become a lien on the unit after 30 days, and the association can foreclose. New buyers are liable for unpaid assessments from prior owners unless they obtain a statement of amounts due.
- Leasing & rentals: You may rent your entire unit, but you cannot rent out only a portion (e.g., a room), and transient tenants (short-term rentals) are prohibited. Tenants must comply with the declaration and bylaws.
- Use restrictions: Units must be used as a residence for a single family only. No business, trade, or profession may be conducted on the property. No signs may be displayed except 'For Sale' or 'For Rent' signs on unsold or unoccupied units. You cannot do anything that impairs structural integrity or increases insurance rates without board consent.
- Alterations & approvals: You may alter, redecorate, or repair the interior of your unit as long as it doesn't affect the exterior appearance or structural integrity. Any changes to common areas (including buildings) require the association's written consent.
- Parking & limited common areas: At least two parking spaces are assigned to each unit by the board, and these spaces are limited common areas for your exclusive use. You also have exclusive use of your front stoop and rear patio/deck (size varies by unit type). Maintenance of parking areas is a common expense.
- Insurance & damage: The association insures all buildings and common-area personal property for replacement value, plus liability coverage for common areas. You are responsible for insuring your own personal property and liability. If buildings are more than two-thirds destroyed, owners of three-fourths of the floor space can decide not to rebuild, and the property may be treated as tenants in common.
- What this document doesn't cover: This is the declaration for Phase One only; it references additional phases and bylaws (attached but not fully included here). It does not specify pet rules, rental lease minimums, or age restrictions. Those may be in the bylaws or later amendments.
