Winding Marsh is a planned single-family home community in Wilmington, NC, governed by a homeowners association (HOA). This document is the full set of covenants, conditions, and restrictions that apply to all lot owners. It covers what you can build, how you can use your property, and the HOA's powers to assess fees and enforce rules.
- What you own & maintain: You own your lot and the house on it. You must maintain your lot (lawn, trees, structures) in a safe, clean condition. The HOA maintains common areas, entrance signs, the central mailbox, and stormwater controls. You are responsible for street trees adjacent to your lot and any septic system on your property.
- Assessments & fees: Annual assessments start at $1,600 per lot (as of 2021) and can increase up to 15% per year without a vote. Special assessments for capital improvements require 75% approval. A one-time capital contribution of $1,000 is due at first sale. Assessments are a lien on the lot if unpaid.
- Architectural review: Almost all exterior changes (buildings, fences, landscaping, paint, play equipment, solar panels, etc.) require prior written approval from the Architectural Review Committee (ARC). The ARC has 45 days to respond; if no response, plans are deemed approved (unless they violate the declaration). Vinyl siding is prohibited.
- Leasing & rentals: You may lease your entire house for at least 12 months. No subleasing, short-term rentals (Airbnb, VRBO), or transient use allowed. Leases must be in writing, require tenant to comply with HOA rules, and may need to be registered with the HOA.
- Pets: Up to 3 household pets (dogs, cats) allowed. Prohibited breeds: Pit Bulls, Rottweilers, Doberman Pinschers, Staffordshire Terriers, or mixes containing them. No doghouses, kennels, or runs. Pets must be leashed off your lot, and waste must be cleaned up.
- Parking & vehicles: Park only in garage or driveway. No boats, trailers, RVs, campers, or recreational vehicles may be parked outside unless screened from view. No inoperative or unlicensed vehicles. No tractor-trailers. Garages cannot be converted to living space; doors must stay closed except when entering/exiting.
- Use restrictions: Lots are for single-family residential use only. No businesses except with board approval. No temporary structures (tents, storage containers) for residential use. No outside clotheslines. Garbage cans must be screened. Flags: one US flag up to 4x6 ft, plus one flag up to 3x5 ft on rear of house. Political signs allowed 45 days before election, removed within 7 days after.
- Stormwater & environmental rules: Each lot is limited to 3,600 sq ft of built-upon area (BUA). A 50-ft vegetative setback must be maintained near surface waters. No alteration of drainage without state approval. Protected trees (shown on Exhibit A) must be preserved and replaced if lost.
