What The Townhomes at Smithfield II Homeowners Association, Inc.'s governing documents say
The Townhomes at Smithfield II is a planned community of attached townhomes in Sunset Beach, NC, governed by a homeowners association (HOA). This declaration creates the community and sets rules for owners, including maintenance obligations, rental restrictions, and architectural controls. The community is part of the larger Brunswick Plantation master association, which provides additional amenities.
- What you own & maintain: You own your lot and dwelling unit. The HOA maintains all common areas, limited common areas (driveways, sidewalks), and the exterior of all dwelling units. You are responsible for interior maintenance and must not perform landscaping on common areas.
- Leasing & rentals: Leases for less than 21 consecutive days are prohibited. Tenants are not entitled to use the Brunswick Plantation clubhouse or its amenities.
- Architectural review: No exterior changes (buildings, fences, signs, painting, antennas, etc.) may be made without prior written approval from the HOA board. The board has 30 days to respond; if no response, approval is deemed given. Satellite dishes must comply with the Telecommunications Act and not be visible from the street.
- Assessments & fees: Monthly assessments started at $345 per lot in 2011 and are set by the board. A working capital fund requires a payment equal to two months' assessment at closing, plus $100 to the master association. Special assessments may be levied for insurance shortfalls, repairs, or other needs.
- Party walls: Walls shared between units are party walls. Repair and maintenance costs are split equally between adjoining owners, unless damage is covered by insurance or the wall is an exterior wall for only one unit.
- Pets & animals: No animals, livestock, or fowl may be raised, bred, or kept except as allowed by the Brunswick Plantation Master Declaration.
- Master association & amenities: All owners are members of the Brunswick Plantation Property Owners Association and may use its clubhouse and amenities. Owners also have access to a large swimming pool complex at The Lakes condominium; costs are shared equally among certain communities.
- What this document doesn't cover: This document does not specify pet limits, parking rules, or age restrictions. It also does not detail the master association's rules or the exact amenities available.
