What 409 Brunswick Street Owner's Association's governing documents say
This is the Declaration of Covenants, Conditions and Restrictions for 409 Brunswick Street Townhomes, a townhome community in Wilmington, NC. It establishes a homeowners' association (409 Brunswick Street Owner's Association) and binds all lot owners, tenants, and occupants. The document covers property rights, assessments, use restrictions, architectural control, party walls, and insurance.
- What you own & maintain: You own your lot and the townhome on it. The association may maintain future common areas, but each owner must keep their lot free of weeds, debris, and unsightly conditions. Party walls (shared walls between townhomes) are jointly maintained by the owners who use them.
- Assessments & fees: Annual assessments are set by the board based on an adopted budget; special assessments for capital improvements require a majority vote of owners. Assessments are a personal obligation and a lien on the lot if unpaid. Late fees and interest apply after 30 days.
- Architectural review: No exterior changes (including painting, fences, or structures) may be made without written approval from the Declarant or, after all lots are sold, the board. Plans must show design, materials, colors, and location. Minimum dwelling size is 1,000 heated square feet.
- Use restrictions: No noxious activities, temporary structures used as residences, or commercial pet keeping. Vehicles: no campers, trailers, inoperable vehicles, or repairs visible from the street. Trash cans must be hidden except on pickup days. Christmas decorations only Nov 20–Jan 7. Satellite dishes under 18 inches not visible from the street are allowed.
- Pets: Dogs, cats, or other household pets are allowed but not for commercial purposes. They must be leashed when outside the unit, and owners must clean up waste. No livestock or poultry.
- Parking & vehicles: No boats, trailers, inoperative cars, or similar vehicles may be left on lots or common areas without board consent. Parking must not block access to other lots. Vehicles must have current registration and insurance.
- Party walls: Walls built on lot dividing lines are party walls. Repair costs are shared proportionally by owners who use the wall. If an owner's negligence causes damage, that owner bears the full cost. Disputes go to arbitration.
- Insurance: The association carries casualty and liability insurance on common areas. Each lot owner must insure their own unit for full replacement value and provide proof to the association. If an owner lapses, the association may procure insurance at the owner's expense.
