Harrells Lane is a standard single-family homeowners association (HOA) in Wilmington, NC. The document establishes the HOA to own and maintain a private road (the Common Area) for the benefit of adjacent lot owners. It applies to all lot owners, who are automatically members of the association.
- What you own & maintain: You own your lot in fee simple. The association owns and maintains the Common Area (a private road) and is responsible for its upkeep, insurance, and taxes. Lot owners have an easement to use the Common Area for access and other intended purposes.
- Assessments & fees: The association may levy general assessments for common expenses, special assessments for capital improvements (with 2/3 owner approval), and individual assessments for fines or costs due to rule violations. Assessments are due at least annually; unpaid assessments become a lien on the lot and may be foreclosed.
- Voting & membership: Each lot gets one vote in the association. Owners may delegate use of the Common Area to family members and tenants. The Common Area cannot be mortgaged or conveyed without consent of 2/3 of owners.
- Use restrictions: Lots must remain residential in nature. The association may suspend voting rights and Common Area use for nonpayment of assessments. The association can adopt rules and regulations for Common Area use.
- Duration & amendment: These covenants run for 20 years from recording (2002), automatically renewing for successive 20-year periods unless a majority of owners vote to revoke. Amendments require a 2/3 vote of lot owners and must be recorded.
