What Mason Bend Property Owners' Association's governing documents say
Mason Bend is a single-family home HOA in Wilmington, NC. This document is the full set of restrictive covenants that run with the land, binding all current and future lot owners. It covers what you can build, how you must maintain your property, and the association's assessment and lien powers.
- What you own & maintain: You own your lot and the house on it. You must keep your property clean and tidy, cut weeds and brush, and maintain the curb area in front of your lot. The association may enter your lot to remove unsightly growth or trash if you don't, and charge you for it.
- Architectural review: No building, fence, wall, or other structure may be built or altered, and no grading or tree removal may occur, without prior written approval from the Declarant (or the Board acting as Design Review Committee). Approval may be based on purely aesthetic grounds. Plans must include exterior colors, finishes, site and landscaping plans.
- Minimum house size & setbacks: New homes must have at least 2,000 sq ft of enclosed dwelling area for one-story, or 2,100 sq ft for two-story. Front setback is 40 feet, side setbacks minimum 10 feet. Variances are allowed to overcome practical difficulties.
- Use restrictions: Lots are for single-family residential use only. No apartments, duplexes, businesses, professional offices, or religious institutions. No trailers, mobile homes, or temporary structures (except contractor shelters during construction). No fuel tanks exposed to view.
- Parking & vehicles: Each lot must provide off-street parking for three cars before occupancy. Cars may not be parked on lawns, grass, or backyards. Only fully operational vehicles with current tags may be parked on the property. No trailers, boats, or habitable motor vehicles unless inside an enclosed garage.
- Pets: Pets must be contained in front or rear yards using fences (rear yard) or electronic fences (front or rear yards). This applies to dogs, cats, and any other domestic animals.
- Assessments & liens: Each lot owner pays a quarterly assessment set by the association. The initial annual assessment was $500 per lot. Unpaid assessments become a lien on the lot after 30 days, bear 12% interest, and can be foreclosed like a mortgage. The association may also levy additional assessments for emergencies.
