- What you own & maintain: You own the interior of your unit (including flooring, cabinets, fixtures, appliances, and HVAC/plumbing/electrical serving only your unit). - Parking & vehicles: Parking spaces designated on the plat by unit number are limited common elements reserved for that unit's exclusive use. The developer reserved the right to construct carports and assign them as limited common elements.
- Assessments & fees: Common expenses are shared in proportion to each unit's percentage of value (based on square footage). The board sets regular and special assessments; special assessments over $50 per unit per year or capital improvements over $5,000 require majority member approval. Unpaid assessments bear interest at the highest legal rate and become a lien after 30 days.
- Use restrictions: Units are restricted to single-family residential use. No obstruction or storage in common elements. Nothing may be done that increases insurance rates on common elements without written consent. Owners must keep units in good repair and comply with all rules.
- Developer control: Until June 30, 1978, the developer (Declarant) could amend the declaration and by-laws without owner consent (subject to limited conditions) and had approval power over all actions of the owners or board. The developer also served as the management firm until the first annual meeting or final declaration.
