What Quads at Oleander's governing documents say
Quads at Oleander is a planned community of townhomes in Wilmington, NC, governed by a homeowners' association (HOA). This declaration applies to all owners, residents, and guests, and covers use restrictions, maintenance responsibilities, architectural controls, and mandatory assessments.
- What you own & maintain: You own your unit's interior, patio, balcony, and HVAC unit. The association maintains all exterior surfaces (roof, siding, gutters, windows, doors, exterior lighting) and common areas, including landscaping and streets until accepted for public maintenance.
- Architectural review: Any exterior change, construction, or landscaping must be approved in writing by the board. Plans are deemed approved if not acted on within 60 days. The board may withhold approval for any reason, including aesthetics, and may stop non-compliant work.
- Leasing & rentals: Units may be leased for residential purposes with a minimum lease term of at least 2 days. Leases must require tenants to comply with the declaration and rules; owners are responsible for tenant violations.
- Pets: No more than 2 common household pets (dogs, cats) per unit. Pets must be leashed when outside a fenced area. The association can require removal of any pet deemed dangerous, noisy, or a nuisance.
- Parking & vehicles: Maximum 3 resident vehicles per unit plus 1 guest vehicle. No boats, trailers, RVs, or commercial vehicles may be parked outside a garage. All vehicles must be properly licensed and operable. Street parking is prohibited.
- Assessments & fees: Annual assessment is $3,000 ($250/month). A one-time capital assessment of $2,500 is due at purchase. Assessments can increase up to 10% per year without a vote; larger increases require majority approval. Special assessments may also be levied.
